Terms of Service

These Terms of Service (“Terms”) govern your access to and use of topcal (the “Service”), operated by Top of Funnel, LLC. By creating an account or using the Service, you agree to these Terms. If you are using topcal on behalf of an organization, you represent that you are authorized to bind that organization.

Our Privacy Policy describes how we handle personal data. Marketing pages on this site are subject to the same commercial terms for product use once you sign up on app.topcal.ai. Canonical product Terms live at topcal.ai/terms.

The Service

topcal is agent-native scheduling software. It lets you connect a calendar, define availability and event types, publish booking links, and allow authorized AI agents to read availability and book meetings on behalf of verified humans through our API, MCP server, CLI, and related surfaces.

Accounts & eligibility

• You must provide accurate information and keep your account credentials, passkeys, and API keys secure.
• You are responsible for all activity under your account and any agent or API key you authorize.
• You must be at least 18 years old to use the Service.

Trial, Starter plan & Enterprise

New workspaces receive a 14-day free trial with full Starter access and no credit card required. After the trial, a workspace that has not subscribed is paused: connected calendars may remain linked, but the workspace cannot take new bookings until a subscription is started.

The self-serve paid plan is Starter, billed $15 per connected calendar per month (or the then-current annual rate shown at checkout) through Stripe. Seat quantity tracks connected calendars. Enterprise features (for example SSO, custom domain, or contract terms) are available under a separate agreement. You can change or cancel a self-serve subscription from the billing portal; cancellations take effect at the end of the current billing period. Except where required by law, payments are non-refundable.

Calendar connections

Connecting Google or Microsoft Calendar authorizes topcal to read availability and create, update, and cancel events as needed to provide the Service. You are responsible for having the right to grant that access and for complying with your calendar provider’s terms.

Agents & API use

If you enable agents or issue API keys, you must ensure that bookings and other writes are performed only for humans who have been verified as required by the Service (for example email OTP) and who have a legitimate basis to meet. You must not use agents to circumvent consent, spam, or abuse rate limits.

Acceptable use

You agree not to:

• Use the Service to send spam, harass, or book meetings without a legitimate basis.
• Reverse engineer, resell (except as expressly allowed), or abuse the Service, its API, OTP flows, or rate limits.
• Violate any law or the terms of any connected calendar provider (including Google and Microsoft).
• Access another user’s data without authorization, or use an agent to act on behalf of a human who has not been verified.

Third-party services

The Service integrates with third parties such as Google Calendar, Microsoft, and Stripe. Your use of those services is subject to their own terms and policies. We are not responsible for third-party services. Our handling of data from Google and Microsoft APIs is described in our Privacy Policy.

Your content

You retain ownership of your data (event types, availability, bookings, and connected-calendar data). You grant us a limited license to process that data solely to provide and improve the Service as described in the Privacy Policy.

Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee uninterrupted or error-free operation, or that scheduling will always be accurate. You are responsible for confirming important meetings.

Limitation of liability

To the maximum extent permitted by law, Top of Funnel, LLC and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising from your use of the Service. Our total liability for any claim will not exceed the amount you paid us for the Service in the 12 months before the claim arose.

Indemnity

You will defend and indemnify us against claims arising from your misuse of the Service, your content, your agents’ actions, or your violation of these Terms or applicable law.

Termination

You may stop using the Service and request account deletion at any time by contacting support@topcal.ai. We may suspend or terminate access if you violate these Terms or use the Service in a way that risks harm to others or to the Service.

Governing law

These Terms are governed by the laws of the State of Delaware, USA, excluding conflict-of-law rules. Courts located in Delaware will have exclusive jurisdiction over disputes, except that we may seek injunctive relief in any jurisdiction.

Changes

We may update these Terms from time to time. We will post the updated version here and revise the effective date. Continued use of the Service after changes take effect constitutes acceptance.
